Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the CampSpark mobile application (the “App”) or the website at campspark.online (the “Website”), you (“you” or “User”) agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the App or the Website.

CampSpark is operated by Pyqlexity, a sole proprietorship registered in India (the “Operator”).

2. Eligibility

• You must be at least 18 years of age. By using the App, you affirm that you are 18 years or older.
• You must register with a valid email address. Sign-in via Google is optional.
• You must not have been previously banned or removed from CampSpark for violation of these Terms.
• You agree to provide accurate registration information including gender. Your gender selection is permanent and cannot be changed after first login.

3. Zero-Tolerance Policy on Objectionable Content

You agree NOT to upload, transmit, or share any of the following through your bio, chat messages, or any other surface of the App:

• Sexually explicit, pornographic, or nude content
• Content depicting, encouraging, or glorifying violence, self-harm, or harm to others
• Hate speech or content targeting individuals or groups based on race, religion, ethnicity, gender, sexual orientation, disability, caste, or nationality
• Content involving minors or content sexualizing minors in any way
• Content infringing on the intellectual property, privacy, or publicity rights of any person
• Threats, harassment, stalking, intimidation, doxxing, or non-consensual sharing of intimate images
• Spam, scams, fraudulent solicitations, multi-level marketing, cryptocurrency promotion, or any unauthorized commercial activity
• Promotion of illegal substances, weapons, or activities under Indian law

Our 24-Hour Moderation Commitment

1. In-app reporting. Any user can report any other user from the chat header, the profile sheet, or the bubble interaction, with reasons including inappropriate photos, harassment, fake profile, spam, underage user, and other.
2. One-tap blocking.Blocking is immediate, mutual, and irreversible from the blocked user's perspective. A blocked user cannot send pings to you, see you in discovery, or contact you. Server-side rules enforce the block at the database layer.
3. 24-hour review. All reports are reviewed by our moderation team within 24 hours of submission. Confirmed violations result in immediate content removal and, for serious or repeated violations, permanent account termination.
4. No-notice removal. We reserve the right to remove content and suspend or terminate accounts at our sole discretion, with or without prior notice.
5. Cooperation with law enforcement. Where content depicts illegal activity (including but not limited to child sexual abuse material, threats of violence, or trafficking), we will report it and cooperate fully with Indian and international law enforcement.

By using the App you acknowledge that you have read and accept this Zero-Tolerance Policy.

4. Acceptable Use

You agree NOT to:

• Harass, bully, threaten, stalk, or intimidate any other User
• Send unwanted repetitive pings, messages, or solicitations
• Create multiple accounts, impersonate any person, or use a false identity
• Use the App for any illegal activity under Indian law
• Reverse-engineer, decompile, scrape, or extract source code, schemas, or assets
• Interfere with, disrupt, overload, or compromise the App's infrastructure
• Use automated scripts, bots, or scrapers to interact with the App
• Use the App for commercial advertising, promotion, or solicitation
• Share personal contact information (phone numbers, social media handles, addresses, payment details) in ways that compromise the safety of yourself or others

4a. How CampSpark Detects Other Users

CampSpark uses Bluetooth Low Energy (BLE) signals exclusively to detect other CampSpark users in your physical proximity (typically within 30–50 meters). The app does not use GPS, Wi-Fi scanning, or any location-based service. The Bluetooth signal carries only an anonymized hash of your user identity and your gender (1 byte). No location coordinates are ever transmitted from your device. You can disable Bluetooth-based detection at any time using Privacy Mode or Full Stealth in the app, or by turning off Bluetooth entirely on your device.

5. Account Registration

You may only create one (1) account per person. Multiple accounts may be detected and terminated without notice. Your gender selection at first login is permanent and cannot be changed. You are responsible for the security of your account and any activity that occurs through it.

6. User-Generated Content

You retain ownership of the content you provide (your bio). By providing content, you grant Pyqlexity a non-exclusive, worldwide, royalty-free, fully transferable license to display that content within the App to other Users solely for the purpose of the App's functionality. You represent and warrant that you have all necessary rights to grant this license. We may remove any content that violates these Terms with or without notice.

6a. Prohibited Content

The following content is strictly prohibited and will be removed immediately on detection or report. Repeat offenders are permanently banned:

• Sexually explicit, pornographic, or nude content
• Content depicting minors in any context
• Hate speech, harassment, threats, or discriminatory content
• Content that promotes violence, self-harm, or illegal activity
• Impersonation of other persons or brands
• Spam, advertising, or commercial solicitation

CampSpark uses a combination of user reports and manual review to enforce this policy. We reserve the right to permanently delete content and ban accounts at our sole discretion.

7. Block, Report, and Account Deletion

• Block: Mutual and immediate. The blocked user cannot send you pings, message you, or appear in your discovery. Server-side enforcement prevents bypass.
• Report: Reviewed within 24 hours. False or malicious reports may themselves result in action against your account.
• Account deletion: Available in-app at Settings → Delete Account, or by emailing privacy@campspark.online (completed within 7 calendar days). All data — profile, sent and received pings, conversations and messages, active subscription, AWS Cognito identity — is irreversibly removed. A public deletion-request page is available at campspark.online/delete-account.

8. Safety

CampSpark does not perform background checks on Users. We make no representation regarding the identity, character, or intentions of any User. You interact with other Users entirely at your own risk. If you choose to meet someone you discovered through the App:

• Meet in public, well-lit places
• Inform a friend or family member of your plans
• Trust your instincts — leave if anything feels wrong
• Never share financial information

CampSpark is a discovery and messaging service only. We do not facilitate transactions, dates, or meetings between Users and are not liable for the outcome of any interaction.

9. Subscriptions, Auto-Renewal, and Billing

9.1 Subscription Tiers

CampSpark offers optional auto-renewing subscription tiers in India:

Prices include all applicable taxes (GST). Subscriptions are billed in Indian Rupees only.

9.2 Billing Method

Subscriptions are processed through Razorpay Software Pvt. Ltd., a Payment Aggregator licensed by the Reserve Bank of India. CampSpark is an Indian developer serving Indian users in compliance with the Competition Commission of India's Order dated 25 October 2022 in Case No. 39 of 2018, which directs that Indian app developers may not be restricted from using third-party billing systems for in-app purchases.

By subscribing, you authorize Razorpay to charge the payment method you select (UPI, debit card, credit card, or net banking) at the start of each billing cycle until you cancel.

9.3 Auto-Renewal

Subscriptions renew automatically each month on the anniversary of your subscription start date. You may cancel auto-renewal at any time from Settings → Manage Subscription before the next billing date. Cancellation takes effect at the end of the current billing cycle; you retain access to the subscribed tier until that date.

9.4 Refunds

Subscriptions are non-refundable except where required by law. If you are charged in error, contact support@campspark.online within 7 days of the charge with proof of the transaction; we will review and, at our sole discretion, refund or credit the amount.

9.5 Price Changes

We reserve the right to change subscription prices. Price changes will be notified at least 30 days in advance through the App or by email. Continued subscription after the effective date constitutes acceptance of the new price.

9.6 Tax

All prices include applicable Indian GST. Pyqlexity is the merchant of record (GSTN: 07BRQPA6643B1ZY) and issues GST invoices on request. Email support@campspark.online with the transaction ID and your GST registration details.

10. Intellectual Property

The CampSpark name, logo, design, source code, AWS infrastructure configuration, and all related intellectual property are owned exclusively by Pyqlexity. No license is granted by these Terms except as expressly stated. You may not copy, modify, distribute, publish, or create derivative works of any part of the App or Website without prior written permission from Pyqlexity.

11. Termination

• By you: Delete your account anytime as described in Section 7.
• By us: We may suspend or permanently terminate your account immediately and without notice if you violate these Terms. We may terminate inactive accounts after extended dormancy.
• Effect of termination: All access to the App is revoked. Active subscriptions are auto-cancelled (no further charges). Data is deleted per Section 8 of the Privacy Policy.

11a. Appealing a Suspension or Ban

If your account has been suspended or banned and you believe the action was taken in error, you may email support@campspark.online within 30 days. Include your registered email address and a description of the situation. We will review and respond within 7 business days.

12. Disclaimers

The App and Website are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be available without interruption or error, that proximity detection will function reliably in all environments, that you will receive pings or matches, or that information displayed by other Users is accurate.

13. Limitation of Liability

To the maximum extent permitted by law, Pyqlexity, its proprietor, and its affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profit, personal injury, emotional distress, or any damages arising from:

• Your interactions with other Users, online or in person
• Unauthorized access to your account or data
• Service interruptions, errors, or downtime
• Content posted by other Users
• Any other matter arising out of or in connection with your use of the App or Website

In no event will our aggregate liability exceed the amount you paid to Pyqlexity in the 12 months preceding the event giving rise to liability, or ₹10,000 (whichever is lower).

14. Indemnification

You agree to indemnify, defend, and hold harmless Pyqlexity, its proprietor, employees, and affiliates from any claim, loss, damage, liability, or expense (including reasonable legal fees) arising from your use of the App, your User-Generated Content, your violation of these Terms, or your violation of any third-party right.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles. Any dispute arising from or relating to these Terms or your use of the App or Website shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

16. Changes to Terms

We may amend these Terms from time to time. The “Last updated” date at the top reflects the latest revision. Material changes will be notified through the App at least 14 days in advance. Continued use of the App after the effective date constitutes acceptance of the new Terms.
